The long-running legal drama surrounding the final funeral rites of legendary Ghanaian highlife musician Charles Kwadwo Fosu, popularly known as Daddy Lumba, has taken a new turn as the Kumasi High Court on Tuesday, October 28, 2025, dismissed an interlocutory injunction filed by Akosua Serwaa, the first wife.

The application, filed by Madam Akosua Serwaa Fosu, sought to restrain the late singer’s family from going ahead with his final funeral rites until the court determined her claim as the only surviving spouse and rightful widow of the music icon.

Akosua Serwaa argued that she was legally married to Daddy Lumba in Germany in December 2004, and that the family’s decision to proceed with funeral arrangements without consulting her was a violation of her rights.

However, in her ruling today, Her Ladyship Justice Dorinda Smith Arthur held that under Ghana’s customary law, the authority over a deceased person’s body rests with the family, not necessarily the spouse.

She stated that granting the injunction would delay the funeral and cause unnecessary tension among the parties involved.

“Accordingly, the application for interlocutory injunction is hereby refused,” the presiding judge declared.

The ruling effectively gives Daddy Lumba’s family the legal clearance to continue with preparations for his final farewell, which has been scheduled to take place on Saturday, December 6, 2025, at the Baba Yara Sports Stadium in Kumasi.

Per reports, the courtroom on Tuesday was packed with family representatives and supporters of both sides, including lawyers for Akosua Serwaa and Priscilla Ofori, popularly known as Odo Broni, who has also been linked to the late musician.
