    A hardworking father died after collapsing just feet from a New Jersey emergency room where a nurse had allegedly dismissed his desperate breathing problems by claiming he regularly came to the hospital and ‘pretends to be sick.’

    Jerome White, 35, was screaming that he could not breathe after leaving Cooper University Hospital in Camden on the night of June 3, 2020, as sheriff’s officers watched his condition rapidly deteriorate outside.

    White, who had a long history of severe asthma, had initially received treatment inside the hospital before being discharged during the chaotic early months of the COVID-19 pandemic, according to a police report obtained by NJ.com.

    But when officers expressed concern about the frantic father and twice approached hospital personnel about his condition, they were told he had already been treated and needed to leave.

    On the second occasion, Officer Pierre Buchaillot specifically told an on-duty nurse that White appeared to be struggling.

    ‘The nurse advised Officer Buchaillot that Mr. White comes here all the time and pretends to be sick,’ the incident report states.

    Moments later, White collapsed.

    He initially ‘plopped to the ground’ and rolled around before coming to rest on his stomach, according to the officers’ account.

    White then fell silent as the officers continued speaking to him and tried to calm him.

    When they attempted to move him from the pavement to a nearby bench, they discovered his body had gone limp and his lips were turning blue.

    Buchaillot raced back into the hospital for help, and medical staff rushed outside and began treating White.

    By the time he was placed onto a stretcher and taken back through the emergency room doors, he had stopped breathing, according to the report.

    White never recovered from the catastrophic loss of oxygen to his brain. 

    He died at Cooper on June 19, some 16 days after he had first walked into the hospital seeking help for the breathing crisis that claimed his life.

    His death certificate listed anoxic encephalopathy – brain damage caused by a lack of oxygen, and cardiac arrest as his cause of death. 

    It also recorded his longstanding asthma, which was capable of triggering life-threatening attacks.

    The extraordinary circumstances surrounding White’s death would later result in a previously undisclosed $15 million wrongful-death settlement for his family, NJ.com revealed.

    No lawsuit ever reached court. Instead, the agreement was negotiated privately after White’s relatives threatened legal action against Cooper and Camden County, leaving much of what happened inside the emergency department that night shielded from public scrutiny.

    According to estate records reviewed by NJ.com, $12 million of the settlement was apparently paid by Cooper, while Camden County contributed $3 million.

    The agreement contained no admission of wrongdoing.

    ‘It strikes me as an uncommonly large settlement,’ Sara Rosenbaum, professor emerita of health law and policy at George Washington University, told NJ.com. ‘So the hospital’s behavior must have been reprehensible.’

    ‘It had to have been quite a flagrant violation,’ she added.

    Rosenbaum said the circumstances described in the records appeared to constitute a violation of the federal Emergency Medical Treatment and Labor Act, which imposes obligations on hospitals when people arrive seeking emergency treatment.

    Yet precisely what happened before White was sent away remains unclear.

    Camden County said its officers were subsequently investigated by internal affairs and cleared, with none disciplined.

    ‘The officers went and rendered aid and got Mr. White back into the E.D.,’ county spokesman Dan Keashan told NJ.com. ‘That’s basically what the incident report says.’

    The county also maintained that its officers used no force against White and denied violating his rights.

    The tragedy unfolded during one of the darkest periods of the pandemic, when New Jersey hospitals were confronting enormous numbers of desperately ill COVID patients and emergency departments faced extraordinary pressure.

    The settlement included a confidentiality agreement that attorney Jarad Silverstein, who represented White’s family, described in a legal filing as ‘critical’ to reaching the 2021 deal.

    Silverstein’s law firm received $5 million from the settlement- a fee backed by the family and approved by a Superior Court judge.

    Some $10 million was placed into a trust benefiting White’s son, who was only 14 when his father died. 

    Cooper has declined to discuss either its role in White’s death or the multimillion-dollar payout.

    ‘We respect the confidentiality clause of the settlement agreement sought by both parties and, therefore, have nothing to add,’ Cooper University Health Care spokeswoman Wendy Marano told NJ.com.
