    The High Court of Australia has overturned a reduced prison sentence handed to a teenage killer who murdered British woman Emma Lovell during a home invasion.

    Mrs Lovell was stabbed in the heart after the then-17-year-old broke into her family’s house in North Lakes, north of Brisbane, at 11.30pm on Boxing Day 2022. 

    Her husband Lee was wounded during the home invasion.

    The killer, who is now in his 20s, pleaded guilty to four offences, including murder, and was handed down a sentence of 14 years in May 2024.

    Whole noting his decision, Justice Tom Sullivan said the boy was required to serve 70 per cent of that time in detention, after he found the crime to be ‘particularly heinous’.

    In August last year, his sentence was reduced on appeal by almost 18 months, meaning he was to serve a minimum of eight years and four months in prison.

    Justice David Boddice reduced the detention period to 60 per cent, citing the killer’s guilty plea, ‘genuine remorse and prospects of rehabilitation’ as special circumstances.

    However, the High Court overturned the ruling on Wednesday after finding the Court of Appeal should not have interfered with the original prison term, according to ABC News.

    The home invasion led to ‘adult crime, adult time’ changes in Queensland law that allow for youth offenders to face a mandatory life sentence for murder with a minimum 20 years before parole.

    Gim Del Villar, the Queensland Solicitor-General, had called for the sentence reduction to be set aside.

    ‘The appeal court undermined the statutory scheme,’ he told the High Court in April.

    The killer’s male co-offender, also a juvenile, was acquitted of murder at a judge-only trial in October 2024.

    He was found guilty of burglary and assaulting Mr Lovell, and was sentenced to 18 months’ detention – time he has served.
