Lawyer William Kusi, counsel for Akosua Serwaa, the legally wedded wife of the late highlife legend Daddy Lumba, has revealed that if there is evidence that Odo Broni knowingly married the musician while aware that he was already legally married, she could be charged with bigamy.
Speaking to the media at the Kumasi High Court after a hearing related to the dispute over Daddy Lumba’s funeral and widowhood rites, Lawyer Kusi explained that bigamy is a criminal offence in Ghana, and any evidence of a second marriage could have legal consequences.
He stated that his team is ready to act if proof such as a marriage certificate or wedding photographs emerges to confirm that a marriage took place between Odo Broni and the late musician while Akosua Serwaa was still legally married to him.
“If they have pictures of the marriage, if they have certificate of the marriage, it’s called bigamy, criminal offence under our law. Probably we will consider charging the woman for bigamy and we will see how it goes. If there’s evidence that she deliberately got married to Daddy Lumba knowing that he was married is bigamy,” he said.
Lawyer Kusi clarified that he and his client are being cautious in their approach, especially because of the children involved. He mentioned that they are not entirely focusing on the “who is the wife” debate, as their actions could have emotional consequences for the children on Odo Broni who are minors.
“I am restraining myself because if the minors, the kids involved. Lumba gave birth to six kids so we also have to protect the kids. You cannot concentrate overly on the issue of wives, so in all our steps we are mindful of the kids involved in this matter so that they would not be affected,” he stated.
The lawyer also explained how the situation escalated into a legal dispute. According to him, if not for letters written by lawyers representing Daddy Lumba’s family, officially stating that Akosua Serwaa was not the musician’s wife, the case might never have reached this point. He said that those letters compelled his client to take legal action to defend her rights.
“It is her right to participate so she is always willing to participate. If it was not for the letters written, probably we wouldn’t get here, officially engaging a lawyer to write to her that she is not the wife then she has to fight,” he added.
Akosua Serwaa filed a suit at the Kumasi High Court seeking an injunction to restrain Odo Broni from publicly presenting herself as the surviving widow of Daddy Lumba.
In her statement, she argued that her marriage to the musician was legally binding at the time of his death and that by law, she is the rightful person to perform the widowhood rites.
Daddy Lumba passed away on July 26, 2025 at the Bank Hospital after an illness and his burial date has been scheduled to take place on December 6, 2025 in Kumasi.
