William Kusi (L) confirms motion filed against Akosua Serwaa William Kusi (L) confirms motion filed against Akosua Serwaa

Counsel William Kusi, who represents Akosua Serwaa, the wife of the late highlife legend Daddy Lumba, has confirmed that the family head of the late musician, Victor Kofi Owusu Banahene, has filed a motion against his client.

In an interview on Top Radio on October 16, 2025, William Kusi explained what transpired at the Kumasi High Court 5 during the hearing of an injunction application filed by his client.

He disclosed that the legal team for Daddy Lumba’s family head had filed a motion challenging Akosua Serwaa’s legal capacity in the case.

According to him, the motion was served on him after they had returned from court, and not on the other parties involved in the matter.

“When we got to the court, the lawyer for the family head had filed a motion to serve me and not the other parties. The lawyer is challenging the plaintiff’s capacity. So we had to get a date and respond before October 28. We were served when I came home from the court,” he explained.

Akosua Serwaa’s lawyer added that he and his client have until October 28 to file their response to the motion.

He mentioned that while they are prepared to respond legally, they also welcome the court’s advice for both sides to engage in dialogue to resolve the matter peacefully.

According to him, his client is open to mediation but prefers that a neutral third party leads the discussions to ensure fairness and transparency between the two sides.

The court case stems from a lawsuit filed by Akosua Serwaa at the Kumasi High Court on October 2, 2025.

In the suit, she accused the family head and other associates of sidelining her in the planning of her husband’s funeral.

She is seeking an injunction to stop the funeral arrangements and a legal declaration that she is the late musician’s only lawful wife and therefore the sole person entitled to perform the widowhood rites.

The first hearing was held on October 16, 2025, before Justice Dorinda Smith Arthur.

At the Kumasi High Court, lawyers representing Kofi Owusu and Priscilla Ofori, popularly known as “Odo Broni,” challenged Akosua Serwaa’s right to bring the case before the court.

However, Akosua Serwaa’s legal team opposed their argument, insisting that the court should first address their request for an injunction before considering any objections.

Justice Smith Arthur after hearing both sides, adjourned the case to October 28, 2025, to allow all parties to file the necessary documents.

She also encouraged both sides to explore an amicable resolution to the matter.
