    GHANA’S former Finance Minister, Ken Ofori-Atta, is seeking to regularise his stay in the United States by applying for permanent residency while contesting efforts to extradite him to Ghana over alleged corruption-related offences.

    Mr Ofori-Atta, who is wanted in Ghana, is currently appearing before an immigration judge after overstaying his visa. He is facing David Gardey, an immigration judge, and attends proceedings from an U.S. Immigration and Customs Enforcement (ICE) detention facility in Virginia, not far from his apartment in Washington, D.C.

    At the same time, he is challenging extradition proceedings initiated by Ghana’s Attorney-General and Minister of Justice, Dominic Akurutinga Ayine.

    His lawyer, Enayat Qasimi, told U.S-based news outlet, Semafor that the former minister was pursuing what he described as a “pathway to residency” in the United States rather than returning to Ghana, where he believes he would not receive a fair trial.

    According to Mr Qasimi, there are “serious questions” about the independence of Ghana’s judiciary, adding that his client has been subjected to what he described as a political witch hunt over alleged financial offences.

    He left Ghana for the United States on January 4, 2025, reportedly for medical treatment at the Mayo Clinic in Minnesota. However, he was arrested on January 6, 2026, in Washington, D.C., by ICE agents for overstaying his visa.

    Before his arrest, Ghana’s Office of the Special Prosecutor had declared him a fugitive over alleged corruption and procurement breaches.

    Mr Ofori-Atta, together with Strategic Mobilisation Limited and six others, faces 78 counts of alleged procurement violations and causing financial loss of GH¢1.4 billion to the state during his tenure as Finance Minister between 2017 and 2024. The case is currently before a High Court in Accra.

    Mr Ofori-Atta is scheduled to appear again in court on April 27.

    His U.S. visa expired on February 14, 2026, while his visas for the United Kingdom and Canada remain valid until April 2032 and May 2031 respectively.
