A Sydney private school teacher accused of sexually abusing a 15-year-old student will be released from custody after police decided not to press for her detention.
St Augustine’s Brookvale teacher Ella Clements, 24, was granted bail by Magistrate Daniel Reiss at Manly Local Court on Monday.
Police requested a Section 40 stay on the decision to grant bail, giving the Supreme Court three days to decide whether she would be bailed or held on remand.
It was withdrawn on Wednesday afternoon, as reported by the Daily Telegraph, meaning she will be released from custody ahead of future court appearances.
Clements was charged with three counts of aggravated sexual assault and one count of sexually touching a child over a number of alleged incidents earlier this year.
The teacher was allegedly in a sexual relationship with her 15-year-old student in the 12 months prior to her arrest on September 16.
It’s alleged Clements’ suspected conduct was uncovered by the boy’s father who discovered text messages on his son’s phone while they sat at the dining table.
St Augustine’s principal Jonathan Byrne said in a letter to parents that the college had been working with authorities concerning their investigation into Clements.

He said the teacher was stood down and later terminated when the college became aware of the allegations against her.
Magistrate Reiss imposed a number of conditions including that Clements reside with her parents on the state’s north coast and to report to police once a week.
She will have to surrender her passport, not approach any international departure points, stay away from the school and not be in contact with any staff or students.
The court also ordered two acceptable persons had to deposit a $100,000 surety each before Clements could be released.
An apprehended violence order was also imposed to protect the complainant.
She will next face Downing Centre Local Court for a brief service mention on November 27.
