    (L) Akosua Serwaa Fosu has filed an injunction to halt Daddy Lumba's funeral preparation (L) Akosua Serwaa Fosu has filed an injunction to halt Daddy Lumba’s funeral preparation

Akosua Serwaa Fosu, the wife of the late highlife legend Daddy Lumba, has filed an interlocutory injunction to halt the ongoing funeral preparations for her husband.

According to court documents sighted by GhanaWeb, Akosua Serwaa, through her legal team at Dominion Chambers, is contesting the legitimacy of the arrangements, arguing that they were made without her knowledge, consent, or involvement.

Her lawyers described the public announcement of the funeral date as “deeply distressing,” noting that the family only learned about the plans through social media, rather than through any formal communication.

The court documents allege that the head of Daddy Lumba’s family, Abusuapanyin Kofi Owusu, along with a self-appointed funeral committee, acted independently by fixing the funeral for December 6, 2025, without consulting the late musician’s legal wife.

“PRAYING this Honourable Court for an Order restraining the Defendants, their agents, assigns, workmen, etc., from either collecting the body of the late CHARLES KWADWO FOSU a.k.a. DADDY LUMBA from the morgue and performing the burial and final funeral rites of the deceased, upon the grounds set out in the accompanying Affidavit,” the writ stated.

In a related development, the “direct family” of the late musician also issued a press statement confirming that legal steps have been taken to halt the funeral until proper consultations are held. They claimed that since Daddy Lumba’s death on July 26, 2025, there has been a “continuous and deliberate effort to marginalise” his wife in all funeral-related discussions.

The statement also noted that the cause of the musician’s death remains under investigation.

It further reminded the public that the late artiste was legally married to Akosua Serwaa on December 23, 2004, in Bornheim, Germany. Under German law, they added, bigamy is prohibited.

Citing Section 1306 of the German Civil Code (Bürgerliches Gesetzbuch), the family emphasized:

“A marriage may not be entered into if one of the persons is already married,”

adding that any subsequent marriage under such circumstances is “legally void.”

The family emphasised that the legal action was necessary to prevent confusion and to ensure that Daddy Lumba is given a proper and dignified farewell, in accordance with the law and cultural expectations.

“To all Lumba fans and music lovers across the world, we deeply appreciate your love, loyalty, and patience during this difficult time. We kindly ask you to disregard any unofficial announcements regarding funeral arrangements,” the statement read.

It concluded by assuring fans that a “respectful and dignified farewell” will be organised to honour Daddy Lumba’s legacy and the impact of his music.
