    An Accra High Court has granted an injunction filed by the maternal family of the late Highlife musician Daddy Lumba, stopping the funeral from being held on December 13 and preventing the release of his body from the mortuary until the substantive case is determined, reports have stated.

    The ruling follows a contentious legal battle initiated by five maternal relatives: Obaapanyin Afia Adomah Pakoso, Robert Gyamfi (Wofa Yaw Poku Asuafua), Georgina Gyamfi, Ernestina Fosuh and Nana Afia Kobi Pakoso, who filed a writ at the High Court in Accra on December 3 seeking multiple orders to preserve their traditional and legal authority in the burial arrangements.

    The plaintiffs want the first defendant, Kofi Owusu Abuakwa of Kumasi (Abusuapanyin), and former members of a dissolved committee barred from accessing or operating the account.

    The family argued that under customary law, the authority to manage funeral rites and take custody of the body resides with the maternal lineage and expressed concerns that the musician’s remains could be released and funeral plans executed without their consent.

    The family also seeks to freeze and regulate access to the Daddy Lumba Memorial Foundation account at CAL Bank, which is intended to cover funeral and related expenses.

    Nonetheless, the injunction has barred the first defendant from organising burial activities and directs that the third respondent, Transitions Funeral Home, must retain custody of the remains until the outcome of the substantive case.

    The injunction means the final funeral rites, which were scheduled for December 13, 2025, now stand in uncertainty.

    The substantive hearing of the case will continue, where the court will determine the legal and customary rights of the respective parties in the ongoing dispute.
