OJ Simpson lawyer reveals Diddy judge’s subtle signal that rapper will get a LONG prison sentence: Live updates

By GERMANIA RODRIGUEZ POLEO, CHIEF U.S. REPORTER

    Updated: 11:16 EDT, 8 July 2025

The judge in Sean ‘Diddy‘ Combs trial signaled he will hand out a lengthy sentence when he denied him bail, according to OJ Simpson‘s lawyer.

Robert Shapiro, the lead defense attorney in Simpson’s infamous murder trial, said Diddy would likely face two to three-and-a-half years in prison after being acquitted of sex-trafficking and racketeering but convicted for lesser prostitution offenses.

‘Having seen that this judge did not release him on bail, I think a message may be coming that you’re going to be spending a lot more time, so no reason to let you come out and come back in,’ Shapiro told Fox News Digital.

Shapiro noted that in denying Diddy bail, Judge Arun Subramanian mentioned the mogul’s ‘propensity for violence,’ citing the 2016 footage of the rapper assaulting Cassie Ventura in a hotel hallway in Los Angeles.

‘If the judge looks at that tape in his mind and is reminded about it again… I think there is a real chance that a substantial sentence will be forthcoming,’ the attorney said.

Shapiro’s comments come as Diddy, his lawyers, and prosecutors are expected to meet with Judge Subramanian for a post-trial hearing on Tuesday to discuss a sentencing schedule.

Post-trial hearing to focus on sentencing schedule

Diddy will be appear in court remotely on Tuesday at 2pm EST for a post-trial hearing on the sentencing schedule.

The 55-year-old music mogul was acquitted last week of sex trafficking and racketeering charges but convicted on two counts of transporting individuals for prostitution.

His lawyers are pushing for less than the recommended 21 to 27 months behind bars, while prosecutors argue his crimes — and history of violence — justify at least four to five years.

The judge has tentatively scheduled sentencing for October but said he’s open to moving it up, with further discussion expected at today’s hearing.

U.S. District Judge Arun Subramanian will decide Diddy’s sentence and isn’t required to follow the usual federal guidelines, meaning he has plenty of leeway.

Diddy’s lead defense attorney Marc Agnifilo previously urged the judge to release the mogul on a $1 million bond, insisting his client had changed dramatically over the past year.

But Subramanian was unmoved and denied him bail, citing his ‘propensity for violence’ against his ex-girlfiends and accusers Cassie Ventura and ‘Jane.’

The maximum possible sentence for each of the prostitution convictions is 10 years in prison.

Diddy has already spent 10 months in jail since his September arrest.

Diddy’s wild confession to sketch artist who drew him during sex trafficking trial

The 55-year-old music mogul was depicted in court sketches visibly panicking when jurors announced earlier this week that they had reached a verdict on four of the five charges against him.

The images – some of which were commissioned by Jane Rosenberg – provided rare glimpses into the rapper’s mood and demeanor during the high-profile proceedings.

But Combs was not always satisfied with the way Rosenberg was portraying him, even criticizing her work during a break in proceedings last month.

She recounted to PEOPLE how the I’ll Be Missing You singer returned to the Manhattan federal courtroom and mouthed something at her.

Diddy hit by explosive new sex scandal hours after being cleared of most serious charges

The music mogul, 55, and his main accuser Cassie Ventura have been accused of drugging and traumatizing one of the male escorts they hired to participate in their freak offs, Clayton Howard.

Howard, who also goes by ‘Dave,’ claims Cassie gave him an STD and that she aborted his baby without telling him. He says she manipulated him into taking ecstasy and having unprotected sex.

The male escort says both Diddy and Cassie were ‘toxic individuals addicted to opiates and methamphetamines who had no regard for others or the law.’

Howard challenges the narrative of Cassie as a victim, claiming: ‘Ventura was not merely a victim forced into sexual encounters with male escorts, but rather an active and engaged participant who willingly manipulated and exploited others, including Plaintiff, to satisfy the sexually depraved desires of Defendant Combs and herself.’

Witnesses implore judge to keep Diddy locked up

Deonte Nash, a former stylist for Combs and Cassie who reluctantly testified during the trial, told the judge in a letter that bail would ‘send a dangerous message: that wealth and influence can shield someone indefinitely from accountability.’

Cassie, through her lawyer, also encouraged Subramanian to keep Combs in jail.

‘Ms. Ventura believes that Mr. Combs is likely to pose a danger to the victims who testified in this case, including herself, as well as to the community,’ Cassie’s lawyer, Douglas Wigdor, wrote.

    When is Diddy’s sentencing date?

After tentatively setting Diddy’s sentencing for October 3, Judge Arun Subramanian said he is open to a defense request that it happen as soon as possible, with further discussions expected at Tuesday’s hearing.

Diddy likely to reenter domestic abusers program after release

Diddy’s attorney Marc Agnifilo sees a long road ahead once he is freed and resumes work on personal demons, likely reentering a program for domestic batterers that he had just started before his arrest.

‘He’s doing OK,’ said Agnifilo, who speaks with him four or five times daily.

He said Diddy genuinely desires improvement and ‘realizes he has flaws like everyone else that he never worked on.’

‘He burns hot in all matters. I think what he has come to see is that he has these flaws and there’s no amount of fame and no amount of fortune that can erase them,’ he said. ‘You can’t cover them up.’

Defense won jury over by admitting Diddy is a domestic abuser

The verdict in Manhattan federal court came after a veteran team of eight defense lawyers led by Marc Agnifilo executed a trial strategy that resonated with jurors.

Combs passed lawyers notes during effective cross-examinations of nearly three dozen witnesses over two months, including Diddy’s ex-employees.

The lawyers told jurors Combs was a jealous domestic abuser with a drug problem who participated in the swinger lifestyle through threesomes with his girlfriends and other men.

‘You may think to yourself, wow, he is a really bad boyfriend,’ Combs’ lawyer Teny Geragos told jurors in her May opening statement. But that, she said, ‘is simply not sex trafficking.’

Agnifilo said the blunt talk was a ‘no brainer.’

‘The violence was so clear and up front and we knew the government was going to try to confuse the jury into thinking it was part of a sex trafficking effort. So we had to tell the jury what it was so they wouldn’t think it was something it wasn’t,’ he said.

Diddy received standing ovation in jail after acquittals

Diddy got a standing ovation from fellow inmates when the music mogul returned to jail after winning acquittals on potential life-in-prison charges, providing what his lawyer says might have been the best thing he could do for incarcerated Black men in America.

‘They all said, “We never get to see anyone who beats the government,”‘ attorney Marc Agnifilo said a few days after a jury acquitted Combs of sex trafficking and racketeering conspiracy charges.

After federal agents raided Combs’ homes in Los Angeles and the Miami area in March 2024, Agnifilo said he told the “I’ll Be Missing You” singer to expect to be arrested on sex trafficking charges.

‘I said: “Maybe it’s your fate in life to be the guy who wins,”‘ he recalled during a telephone interview briefly interrupted by a jailhouse call from Combs. ‘They need to see that someone can win. I think he took that to heart.’

Alternate Diddy juror describes ‘tame’ freak off videos shown to jury

George also described the video evidence he saw of the ‘freak offs’ at the center of the case against Diddy, who in the end was only convicted of lesser prostitution offenses.

The video evidence remained sealed throughout the trial, and only the jury and lawyers got to see it in court.

Exclusive:The hint Diddy judge gave that rapper still faces VERY long prison sentence

The judge who will decide Diddy‘s prison sentence gave a hint that he will side with prosecutors and apply the full weight of the law against the music mogul.

Former federal prosecutor Jennifer Beidel told DailyMail.com the judge’s comments suggest he will side with prosecutors, who want Diddy to face four to five years – above the guidelines based on the sentences of other similarly situated defendants.

Diddy’s new look after 10 months in jail

Diddy has been sporting a new look in the court sketches from his trial – the only glimpse into the federal courtroom, where no cameras are allowed.

The music mogul’s hair and famous goatee are now mostly white, and he is often wering reading glasses.

Diddy has not been photographed since the day of his arrest, and the world will see a different man whenever he is released.
