    MP-elect for Obuasi East sues EC over second collation and declaration

    A judicial review appeal filed by Samuel Aboagye, the declared winner of the Obuasi East parliamentary election, will be heard by the Accra High Court on Tuesday, December 31, 2024.

    Aboagye is contesting the acts of the Electoral Commission of Ghana (EC) in relation to a second collation and results declaration.

    Patrick Boakye Yiadom is named as an interested person in the lawsuit, which was launched against the EC and raises questions over purported anomalies in the procedure.

    According to a report by myjoyonline.com, Samuel Aboagye through his lawyer, Elikplim L. Agbemava, is asking the court to:

    * Declare the EC’s second collation and declaration of results on December 21, 2024, null and void.

    * Mandate the EC to gazette the results collated on December 8, 2024, which he claims declared him the winner based on Form 1D, signed by all parties involved.

    * Issue an injunction preventing the EC from publishing any results contrary to those on the original Form 1D.

    * Bar Patrick Boakye Yiadom from holding himself out as the elected Member of Parliament for Obuasi East.

    The applicant contends that the Public Elections Regulations, 2020 (C.I. 127) do not permit a second collation or declaration after the official announcement of results.

    He also makes the case that the candidates’ agreement on Form 1D, which summarizes election results, is legally obligatory and cannot be changed without their approval.

    According to Aboagye, he was first proclaimed the victor of the election held on December 7, 2024, and any party who is unhappy with the outcome should contest it through the legal system.
