President John Dramani Mahama has expressed disappointment over the public circulation of a letter from Chief Justice Gertrude Torkornoo before he had the opportunity to review its contents.

The letter, dated March 27, 2025, was a formal request from the Chief Justice asking the President and the Council of State to provide copies of petitions seeking her removal and to allow her at least seven days to respond before any Committee of Inquiry is established.

    Background

📜 Three petitions requesting Justice Torkornoo’s removal were submitted to the President.

📌 March 24, 2025 – The petitions were forwarded to the Council of State for consultation.

📌 March 27, 2025 – The Council of State consented to the next steps in the process.

However, before President Mahama could review the Chief Justice’s response, the letter surfaced on social media and was allegedly shared with:

🔹 The President of the Supreme Court

🔹 The Association of Magistrates and Judges

    🔹 The Ghana Bar Association

    President’s Response

📢 Executive Secretary Calistus Mahama stated that the premature circulation of the letter was concerning.

⚖️ He also cited legal precedent (Frank Agyei Twum v Attorney General, 2005-2006 SCGLR 732) to emphasize the confidentiality of Article 146 proceedings.

President Mahama assured the Chief Justice of due process and confirmed that consultations would continue before any further action is taken.
