Special Prosecutor, Kissi Agyebeng [L] and Ken Ofori-Atta Special Prosecutor, Kissi Agyebeng [L] and Ken Ofori-Atta

The Special Prosecutor, Kissi Agyebeng, has disclosed that former Finance Minister Ken Ofori-Atta has officially notified his office of a medical condition that renders him unavailable for a scheduled appearance.

Speaking at a press conference on Monday, June 2, 2025, Kissi Agyebeng said, “By a letter dated May 28, 2025, Ken Ofori-Atta informed the Office of the Special Prosecutor that he has been diagnosed with cancer.”

According to the Special Prosecutor, Ken Ofori-Atta indicated in the letter that he is “earmarked for surgery on June 23, 2025,” and as such, “he will be unable to appear in this jurisdiction” around that time.

Kissi Agyebeng added, “His lawyers further stated that a change in the scheduled date will be communicated to the Office in due course.”

The Office of the Special Prosecutor (OSP) has once again declared former Finance minister, Ken Ofori-Atta, a wanted person after he failed to honour an in-person invitation for questioning.

According to him, Ofori-Atta’s continued absence and noncompliance had exhausted the OSP’s patience, especially after efforts to accommodate his legal team’s request for a virtual session due to his medical treatment abroad.

“This office has always requested his attendance, and we have indicated clearly to him that we are unwilling to waive it. If we were amenable to taking any statement from Ken Ofori-Atta in absentia, we would have done so in February, and not waited till June 2, 2025,” Kissi Agyebeng emphasizsed.

The former minister’s legal team had earlier submitted documentation to the OSP and the Human Rights Court explaining that he was undergoing medical treatment overseas.

However, the OSP insists that Ken Ofori-Atta must be physically present to assist with investigations concerning alleged financial misconduct, including money laundering and causing financial loss to the state.

“We want him here physically, and we insist on it. A suspect in a criminal investigation does not pick and choose how the investigative body conducts its investigations and the methods suitable to him and his convenience. We will not countenance this conduct, not in this case,” the Special Prosecutor stated.

He added that Ofori-Atta is being investigated for several acts of corruption during his time as Minister of Finance.
