    KATH lawyer under fire for failing to defend hospital in battle with Director of Finance

    Shocking details emerging from the High Court in Kumasi have revealed a serious legal blunder by Komfo Anokye Teaching Hospital’s (KATH) own legal representative, which has allowed the hospital’s Director of Finance, Elvis Kusi, to remain in office beyond his official reappointment period.

    According to intercepted court documents, Elvis Kusi, who was reappointed as Director of Finance on December 20, 2021, for a term ending June 30, 2024, filed a suit against KATH on May 19, 2024, just weeks before his reappointment expired.

    In the suit, Kusi argued that his original appointment, dated May 6, 2010, had not been formally revoked or terminated and therefore still stands.

    The KATH Board, chaired by Nana Effah-Apenteng, had directed then-CEO Prof. Otchere Addai-Mensah to instruct the hospital’s legal counsel, Nana Fredua Agyeman Osborn, to file a defense and oppose Kusi’s motion for an injunction.

    However, in a move that has stunned legal observers and hospital stakeholders alike, Mr. Osborn failed to file any affidavit in opposition to the injunction.

    Even more startling, on June 24, 2024, Osborn appeared in court and openly declared that he had no opposition to the injunction being granted against his own client, a public institution.

    The presiding judge, Justice Kwasi Anokye Gyimah, and other lawyers present were visibly surprised by the lawyer’s stance.

    Despite apparent hesitation, the court granted the injunction against KATH.

    Insiders at the hospital suggest that the then-CEO, Prof. Addai-Mensah, allegedly sought to shield both Kusi and the hospital lawyer from accountability.

    It is alleged that when the hospital board attempted to convene a meeting to address the issue, the CEO manoeuvred to prevent it from being included on the agenda, effectively stalling any internal review of the legal mishandling.

    As it stands, Elvis Kusi continues to occupy the role of Director of Finance at KATH beyond the expiration of his reappointment, without a valid appointment letter, a situation many have described as legally untenable.

    With a new board now inaugurated at KATH, attention is turning to what steps the leadership will take to address the legal lapse and restore proper administrative order.

    Stakeholders are calling for urgent action to investigate the matter and enforce accountability within the hospital’s management.
