    A private legal practitioner, Justice Abdulai, has filed a lawsuit against the Attorney General (AG) and the Ghana Police Service (GPS) over the recent appointment of Commissioner of Police (COP) Christian Tetteh Yohuno as Deputy Inspector General of Police.

    A writ dated October 22, 2024 and sighted by GhanaWeb stated that the President, Nana Addo Dankwa Akufo-Addo does not have power to delegate any of the functions of the Inspector General of Police (IGP) to the Deputy Inspector-General of Police in Charge of Operations.

    “According to Article 202(2) of the 1992 Constitution, the operational functions of the police service have been assigned to the Inspector-General of Police and not to his deputy.

    “The President therefore has no power to delegate any of the responsibilities to the Deputy Inspector General of Police,” it said.

    It further noted that the appointment of the Deputy IGP was unconstitutional and doesn’t exist within Ghana’s legal framework.

    “The appointment of Deputy Commissioner of Police, Christian Tetteh Yohonu, as Deputy Inspector General in charge of operations does not exist in our laws”, it stated.

    Justice Abdulai charged the court to interpret and enforce the provisions of Articles 202(1), 202(2), and 202(3) of the 1992 Constitution.

    “A further order restraining the Inspector General of Police or any command under him from accepting, relating to, and/or issuing instructions or commands to COP Mr. Christian Tetteh Yohuno in his assumed capacity as Deputy Inspector-General of Police in Charge of Operation,” he stated.
