    Breakdown of how Supreme Court judges ruled in Kpandai election ‘petition’

    The Supreme Court, on Wednesday, January 29, 2026, overturned the order of the High Court for a rerun of the 2024 parliamentary election for the Kpandai Constituency, which was won by New Patriotic Party’s Matthew Nyindam.

    But the highest court quashed the judgment of the Tamale High Court, presided over by Justice Emmanuel Bart-Plange Brew, where the High Court annulled the parliamentary election results of the Kpandai Constituency and ordered a rerun of the elections.

    The apex court of the land upheld the application filed by Matthew Nyindam, which argued that the election petition ruled on by the High Court was in breach of the timelines for such a petition.

    Five (5) Supreme Court justices, namely Justice Gabriel Pwamang (the presiding judge), Justice Amadu Tanko, Justice Kulendi, Justice Samuel Kwame Adibu Asiedu and Justice Henry Anthony Kwofie, sat on the matter.

    Out of the five, four upheld the application of the NPP MP, which in effect cancelled the by-election announced by the Electoral Commission. One of the justices, however, ruled that the High Court ruling must stand.

    NPP retains seat as Supreme Court cancels Kpandai rerun order

    Here are the justices and how they ruled:

    Justice Gabriel Pwamang:

    Justice Gabriel Pwamang, the presiding judge, was the only one who ruled against Matthew Nyindam’s application.

    Justice Pwamang was the chairman of the five-member committee which recommended the removal of former Chief Justice Gertrude Torkornoo.

    He has been a justice of the apex court since 2015, when he was nominated by President John Dramani Mahama based on the recommendation of the Judicial Council of Ghana.

    Before his appointment to the bench, he was a private legal practitioner and the managing partner of Pwamang and Associates.

    Justice Issifu Omoro Tanko Amadu:

    Justice Issifu Omoro Tanko Amadu voted to uphold Matthew Nyindam’s application.

    He was one of the two judges who voted in favour of Speaker of Parliament Alban Bagbin’s declaration of four seats in the House vacant, when the Supreme Court overturned the action of the Speaker in November 2025.

    Justice Issifu Omoro Tanko Amadu is the first Muslim Supreme Court judge that Ghana has had.

    He was nominated to the court in 2020 by former President Nana Addo Dankwa Akufo-Addo and was sworn into office after his approval by Parliament.

    Justice Tanko Amadu has previously served as Assistant State Attorney, private legal practitioner, judge advocate of the Ghana Navy, Justice of the High Court, Additional High Court Judge sitting on civil matters, narcotics, robbery, and other violent crimes, Director of the Remand Prisoners Project, and a Justice of the Court of Appeal.

    Justice Yonny Kulendi:

    Justice Yonny Kulendi also ruled in favour of the NPP MP’s application.

    Justice Yonny Kulendi was appointed to the Supreme Court in 2020, following his nomination by former President Akufo-Addo.

    Prior to his appointment, he was Managing Partner at Kulendi @ Law, a law firm he founded, and had a strong reputation as an expert in investment law, commercial litigation, and arbitration.

    Justice Samuel Kwame Adibu Asiedu:

    Justice Samuel Kwame Adibu Asiedu also voted to uphold Mathew Nyindam’s application.

    He was the second Supreme Court justice on the committee that recommended the removal of Justice Torkornoo.

    Justice Adibu-Asiedu was sworn in by Akufo-Addo on December 28, 2022, after his nomination in July 2022.

    Justice Adibu-Asiedu became a justice of the High Court in 2006, adjudicating at the Fast Track (Automated) High Court in Accra and the Commercial Court in Accra.

    He was appointed a justice of the Court of Appeal of Ghana in 2019.

    He has also had some stints in academia, working as an adjunct lecturer at the University of Ghana and Central University, as well as a senior lecturer at the Ghana School of Law.

    Justice Henry Anthony Kwofie:

    Justice Henry Anthony Kwofie also upheld the application of the NPP MP, which in effect cancelled the pending by-election.

    He joined the Supreme Court in 2024 after serving as a justice of the Court of Appeal for several years.

    Justice Kwofie was nominated by former President Nana Addo Dankwa Akufo-Addo in July 2023 upon advice from the Judicial Council in consultation with the Council of State.

    Kwofie was sworn into office together with the two other nominees by President Akufo-Addo on January 3, 2024.
