The legal tussle over the funeral arrangements for late Ghanaian highlife icon Charles Kwadwo Fosu, popularly known as Daddy Lumba, took a new turn yesterday after the Kumasi High Court struck out an interlocutory injunction application filed by his wife, Akosua Serwaa.

Despite the dismissal, Lawyer William Kusi, counsel for Akosua Serwaa, expressed contentment with the outcome, describing it as a “levelled score” in an interview following the ruling on Tuesday, October 28, 2025.

Akosua Serwaa, who resides in Germany, had sought the injunction to prevent Daddy Lumba’s family from accessing his body and organizing his funeral on the announced date of December 6, 2025.

This injunction was a component of a larger suit aimed at establishing her recognition as the musician’s only surviving legal spouse and ensuring her inclusion in the funeral preparations. Daddy Lumba passed away on July 26, 2025.

In her statement of claims, Serwaa accused the Abusuapanin (family head), Kofi Owusu, of deliberately sidelining her, noting she only became aware of the funeral date through social media.

A major point of contention centers on the status of the musician’s partners. Akosua Serwaa emphatically stated that she remains the only woman legally married to Daddy Lumba under German law.

She moved to dismiss the claims of Priscilla Ofori Atta, also known as Odo Broni, who is known to have had six children with the deceased, of being a spouse.

However, the family, represented by the law firm Baba Jamal & Associates, vehemently rejected Serwaa’s claims. In a letter signed by Fati Ali-Yallah, the family asserted that Serwaa had no authority to dictate how the funeral should be conducted.

The family claimed that Serwaa had traditionally dissolved her marriage with Lumba in 2018 by returning her head drink, and therefore declared Odo Broni as the only legitimate widow eligible to undergo the customary widowhood rites.

While the injunction application failed, the comments from Lawyer Kusi suggest a strategic view of the court’s decision, perhaps indicating that the core suit regarding Serwaa’s recognition as the legal spouse remains their primary focus in the ongoing legal saga.
