With the court injunction now in place, the fate of the September 2 by-election remains uncertain With the court injunction now in place, the fate of the September 2 by-election remains uncertain

The Action People’s Party (APP) has obtained a court injunction restraining the Electoral Commission (EC) from conducting the Akwatia by-election scheduled for September 2, 2025.

The injunction, secured by the party’s parliamentary candidate, David Ankomah, challenges his disqualification from the race. ‘

Ankomah argues that he met all eligibility requirements, including the submission of a valid tax clearance certificate but was unfairly barred from contesting.

In a writ filed at the High Court in Accra, the APP and its candidate accuse the Electoral Commission of acting with “malice and fraud” in disqualifying him.

The plaintiffs are seeking a perpetual injunction to prevent any actions by the EC that may undermine Ankomah’s candidacy or the interests of the party.

According to the Writ of Summons, dated August 22, 2025, the EC has been commanded to enter an appearance within eight days of service.

The case is expected to proceed in line with court procedures with the Commission required to respond either personally or through legal representation.

The by-election in Akwatia was necessitated by the death of the sitting Member of Parliament, Ernest Yaw Kumi on July 7, 2025.

The 40-year-old first-term legislator, who represented the New Patriotic Party (NPP), passed away after a brief illness.
