    Claims about President John Dramani Mahama‘s eligibility for a third term have sparked discussions among Ghana’s major political parties — the New Patriotic Party (NPP) and the National Democratic Congress (NDC) — as well as among ordinary citizens.

    Ghana’s 1992 Constitution explicitly limits a president to two terms, yet some argue that Mahama’s performance warrants an exception. Among those open to the idea is Freddie Blay, former National Chairman of the NPP, who has stated that he would support the move if the Supreme Court interprets the Constitution in favour of a third term.

    However, two Supreme Court judge nominees have weighed in on the matter, asserting that the Constitution does not permit a president to seek a third term.

    During their appearance before the Appointments Committee of Parliament, they clearly stated their stance on the debate.

    This article explores the views of two Supreme Court judge nominees on President Mahama’s third-term debate.

    Justice Janapare Bartels-Kodwo

    Justice Janapare Bartels-Kodwo, a Supreme Court judge nominee, firmly dismissed speculation about a third presidential term in Ghana.

    Appearing before the Appointments Committee on June 17, 2025, she stated that the Constitution is clear on the matter and emphasised that a president cannot serve more than two terms.

    “It is crystal clear; the president cannot hold office for more than two terms. Period,” she stressed.

    Justice Senyo Dzamefe

    Justice Senyo Dzamefe, another Supreme Court nominee vetted on June 16, 2025, reaffirmed that the Constitution is clear on presidential term limits.

    He emphasised that the rules set out in the Constitution must be strictly followed, stating that if the law mandates two terms, then that is exactly what must be upheld.

    “What the Constitution says is what must be done. If it says two terms, then a president can only serve two terms. I don’t know what interpretation can be put to it other than what is clearly written,” he stated.
