    The Member of Parliament for Manhyia South, Nana Agyei Baffuor Awuah, has questioned the effectiveness of the approach employed by the Special Prosecutor, Kissi Agyebeng, in the ongoing investigations into suspected corruption and corruption-related offences against the former Minister of Finance, Ken Ofori-Atta.

    Speaking on JoyNews’ PM Express on Tuesday, June 3, 2025, the MP argued that the OSP’s strategy appears weak and overly-reliant on the cooperation or presence of Ofori-Atta, which, in his view, raises concerns about the strength of the case.

    “The fundamental question is whether in the absence of Ken Ofori-Atta, they can make progress with the case. If the presence of Ken Ofori-Atta is necessary for determining a prima facie case, then clearly the OSP’s case is weak,” he stated.

    Referencing Ghana’s legal framework, he noted that while Act 29 may require a suspect’s presence, Act 30 allows for action without it.

    He emphasised that Ofori-Atta, under the 1992 Constitution, has the right not to self-incriminate and may choose to remain silent even if arrested.

    “So, what if you arrest him and he refuses to talk? Does that mean the investigation stalls? The approach ought to vary,” he added.

    The MP also criticised what he described as a reactive posture by the OSP, suggesting that Ofori-Atta and his legal team appear to be dictating the pace of the investigation.

    He urged the investigative body to be more strategic in its methods.

    “There are times when investigative bodies pretend to tag along before they strike. That’s why I think the approach by the OSP needs to be varied not just for procedural efficiency, but in the public interest,” he stated.

    The OSP has re-declared Ken Ofori-Atta a wanted person and a fugitive from justice.

    This was after Ofori-Atta failed to appear before the OSP for an investigative interview scheduled for Monday, June 2, 2025.
