Marcellus Wiley will not face domestic battery charges in Florida after an alleged altercation with his wife, Annemarie, according to court records obtained by The Daily Mail.

Monday’s filing in Orange County state court explains that the state of Florida is not filing charges because testimony is ‘not corroborated by any physical or other evidence’ and therefore is ‘insufficient to obtain a conviction.’

There had been a hearing in the case scheduled for last week, but it was ultimately cancelled ahead of Monday’s filing.

The Daily Mail has sought comment from Annemarie’s attorney.

The July 4 arrest affidavit alleged Wiley threatened to kill his wife and became physical with her in front of their children in an Orlando hotel room. Annemarie told police that on the morning of July 3, Wiley stood over her and ‘used one finger to sternly and intentionally poke her in the cheek,’ before threatening to kill her.

The former star of the Real Housewives of Beverly Hills was spotted last week for the first time since her shocking allegations were made public. Annemarie, 42, was not wearing her wedding band on her left ring finger as she stepped out of a black SUV.

She alleged in her filing last month that Wiley’s abuse started back in 2012 and included a number of incidents of physical violence and four alleged rapes. She is also seeking sole legal and physical custody of their three children, and an order denying Wiley visitation.

‘Marcellus subjects me to constant criticism, cruel and sarcastic remarks, and intimidation,’ Annemarie claims in the application.

‘His verbal and emotional abuse is constant, and his physical abuse occurs approximately once a month, and at times more frequently. I am afraid of Marcellus, and I fear for my own safety and for the safety of our children.’

That prompted Wiley to write a lengthy statement in defense, which he sent to The California Post.

Specifically, he called Annemarie’s allegations ‘lies’ and claimed he has ‘videos, photographs, text messages, emails, and other evidence’ that directly contradict the former reality TV star’s ‘baseless claims.’

‘I love my children with everything I am,’ Wiley said in the statement. ‘My highest priority has always been protecting them and preserving the relationship they have with both of their parents.

‘Because of the public allegations made against me by Annemarie, I have been forced to respond with evidence rather than emotion. More importantly, I owe it to my children to truthfully document what they and I have endured.’

Wiley claimed he has proof of Annemarie’s infidelity, including ‘an affair with her pregnant friend’s husband.’

‘As you know, I’m usually the first to break down the truth and separate facts from fiction,’ he added. ‘But because this is now a legal matter – and because my greatest responsibility is protecting my babies, who have already been impacted – I have to handle this differently. When I can speak freely, I absolutely will.’

Wiley was recently hit with sexual assault allegations from four accusers.

The claims, filed four months ago in New York, broaden the litigation that began in 2023 when three women accused Wiley of rape during his time at Columbia University.

Among the new accusers is a former ESPN production assistant who claimed Wiley lured her into a hotel room under the guise of a work meeting in 2009.

In a graphic written statement, the former staffer claimed Wiley emerged from a bathroom naked and physically overpowered her, leaving her ‘petrified.’

The woman told the court: ‘He pushed me up against the windows of the room so hard I thought they would shatter. I was petrified and believed I was going to be killed.

‘I repeatedly pleaded with him to stop and to let me go. He would not. He pushed me face down on the bed and kept me there with my face pressed into the mattress in such a way that I had difficulty breathing, which made me fear for my life.

‘Wiley held me down and masturbated over me until he ejaculated. Only then did he allow me to leave the room.

‘This assault was devastating to me and I live with the affects (sic) to this day. I will never truly escape from that room,’ the former ESPN employee wrote.

Another of the latest accusers claims in the lawsuit that Wiley ‘groomed’ her from the age of 13 before raping her on her 18th birthday.

The unnamed individual alleged that she was just 13 when Wiley first came into contact with her, after visiting her middle school in Buffalo, New York. The woman further claimed that Wiley, a player for the Buffalo Bills at the time, ‘showered her family with free tickets and invitations to his Orchard Park home.’

The accuser alleged that, on her 18th birthday, Wiley flew her to Dallas and ‘shouted at her in a frightening manner and coerced her into sex’.

‘Marcellus Wiley raped me on my 18th birthday, after grooming me from the age of 13, the alleged victim wrote in her account to the court.

Two additional accusers also submitted statements to the court alleging assaults in the late 1990s, including an attack in Culver City and a rape at a USC hotel.

He was first accused of rape back in a November 2023 lawsuit. The accuser, now an Ivy League professor and sociologist, claimed Wiley took her virginity when he assaulted her in 1994.

Wiley has consistently and vehemently denied all allegations, previously using his YouTube channel to dismiss the initial 2023 claims as ‘BS’ and fabrications.

The former lineman admitted that he was ‘interested’ in the alleged victim and that he spent a night with her after allegedly being invited back to her room.

‘If you’re a virgin, I am not going to be your first, because I am not looking at it with the same respect, esteem, honor that you should … We did mess around, but no vaginal intercourse,’ Wiley responded in the video.

Meanwhile, in the accusations that emerged in a March lawsuit, Wiley allegedly pressured a woman for sex after she agreed to go back to his dorm room on October 27, 1994.

After saying no to Wiley ‘repeatedly’, he told her she was ‘too uptight and needed to relax’ before imposing himself on her, according to the lawsuit.

The court papers claim Wiley then ‘swung [her] legs on the bed, lunged towards her and overpowered [her].’

Wiley has denied the allegations on his podcast.

‘For every one of them, I either saw, communicated through email, text, phone, was invited by these individuals after these dates to engage, to be intimate or all the above, after the dates that are in question,’ Wiley said in May. ‘This matters. Why does it matter? Because it directly contradicts the narrative they are trying to present publicly.

‘They are attempting to leverage lies for personal gain, as they say, assassination by accusation, that’s their goal,’ he continued. ‘They trying by lying.’

A product of Columbia University, Wiley played for the Buffalo Bills, San Diego Chargers, Dallas Cowboys and Jacksonville Jaguars during his NFL career. He was selected to the Pro Bowl in 2001.

He has since built a career as a TV analyst, appearing on ESPN and Fox Sports and his own podcast.
