    In an attempt to guarantee Joana Gyan Cudjoe’s spot on the parliamentary ballot for Amenfi Central on December 7, the National Democratic Congress (NDC) has filed a new appeal with the Sekondi High Court. This legal action comes after an Accra High Court dismissed an earlier application in which the NDC argued for Cudjoe’s eligibility and tried to stop the Electoral Commission (EC) from printing ballots and the notice of poll.

    The NDC is hoping that this strategy will give them the time they need to guarantee Madam Cudjoe’s place on the party’s ticket. The NDC is seeking additional legal action in the Sekondi High Court to reverse the current order affecting Madam Cudjoe’s candidacy, according to Dr. Rashid Tanko Computer, Deputy Director of Elections and IT, who spoke to JoyNews.

    “I cannot firmly state that we have actually filed the process as Sekondi High Court and duly served the Electoral Commission to halt any processes,” he explained, citing the Accra High Court’s decision to deny us the injunction due to an earlier injunction that is still in effect. He noted that the goal of the Sekondi High Court hearing scheduled for November 7 is to lift the injunction and make it possible for Madam Cudjoe’s image to be included on the ballot.

    Joana Gyan Cudjoe, the Amenfi Central NDC’s parliamentary candidate, was disqualified by the EC, which has angered the party. The party called the EC’s move “undemocratic, unconstitutional, provocative, and barefacedly instigated” during a press conference hosted by Constituency Secretary Fiifi Sangmoah.

    The contentious issue relates to Madam Gyan Cudjoe’s resounding victory in the May 13, 2023, parliamentary primaries.

    But unhappy people sued, and they were able to obtain an interlocutory order that prevented her from presenting herself as the legitimately elected candidate for a while. On September 8, 2024, new primaries were held after the May 13, 2023, elections were canceled by the NDC’s Functional Executive Committee. Under the supervision of the EC, Madam Gyan Cudjoe triumphed once more.

    The party contends that Madam Gyan Cudjoe’s legitimacy was strengthened and that the May election was overtaken by the September election. The EC disqualified Madam Gyan Cudjoe despite the NDC’s arguments, citing the interlocutory injunction related to the May 2023 election that was canceled.

    The party promises to fight back since it views this decision as a flagrant demonstration of incompetence. The NDC requests that the EC put Madam Gyan Cudjoe’s name back on the Amenfi Central ballots and notice of poll. We shall only recognize the results of the elections held on December 7, 2024, if Madam Gyan Cudjoe is still a candidate. We will not give up until justice is served and the will of the people is restored, as Fiifi Sangmoah underlined.
