    Donald Trump says Democrats‘ bid to use the 14th Amendment to stop him from appearing on the ticket in 2024 is a ‘trick,’ as some states try to advance the effort to boot him from the ballot.

    New Hampshire appears to have the most robust movement so far toward keeping Trump from being able to run for president in the first-in-the-nation primary election state. But voters in other states like Michigan and Florida have also mounted legal battles to challenge the constitutionality of Trump’s White House bid.

    Clause 3 of the 14th Amendment is used as a basis for the anti-Trump argument that the ex-President cannot run for office again after swearing an oath to uphold the Constitution when he took office and then allegations that he engaged in an insurrection, which is what critics call the January 6, 2021 Capitol riot.

    ‘Almost all legal scholars have voiced opinions that the 14th Amendment has no legal basis or standing relative to the upcoming 2024 Presidential Election,’ Trump posted to his social media site Truth Social on Monday evening.

    He added: ‘Like Election Interference, it is just another ‘trick’ being used by the Radical Left Communists, Marxists, and Fascists, to again steal an Election that their candidate, the WORST, MOST INCOMPETENT, & MOST CORRUPT President in U.S. history, is incapable of winning in a Free and Fair Election.’

    States are looking to keep Donald Trump off the 2024 ballot amid arguments the ex-President broke his 14th Amendment oath to uphold the Constitution and is therefore disqualified from the race.

    Specifically, the 3rd clause of the 14th Amendment prevents those from serving in federal or state office if they ‘engaged in insurrection or rebellion against the [U.S.], or given aid or comfort to the enemies thereof.’

    Many claim that Trump’s inaction on that day amounts to involvement and his insistence that the 2020 election was stolen only emboldened those who descended on the U.S. Capitol that day.

    New Hampshire-based attorney Bryant ‘Corky’ Messner, suggested last month that he intends to file a legal challenge questioning Trump’s 2024 candidacy.

    Messner, who ran for U.S. Senate in 2020 with Trump’s endorsement, met last week with New Hampshire’s Republican Secretary of State David Scanlan to discuss keeping Trump off the ballot.

    Scanlan says he is not currently looking to remove any names from the presidential primary ballot and has not sought to do so.

    New Hampshire GOP Chairman Chris Ager has said that the Party is going to ‘fight to make sure that candidates are not denied access to the ballot.’

    Following conservative media personality Charlie Kirk’s claims New Hampshire is trying to keep Trump off the ballot, Scanlan’s office has been inundated with calls from supporters of the ex-President.

    As the state’s top election official, Scanlan could act to keep candidates off the ballots – but the GOP Secretary of State told multiple media outlets that he intends to seek legal advice on the matter.

    In Michigan, the Democratic Secretary of State Jocelyn Benson is also looking for legal opinions on keeping Trump off the ballot under provisions of the 14th Amendment.

    The potential of using the 14th Amendment to disqualify Trump from running for President again gained traction in recent weeks after the ex-President was indicted twice for his role in the scheme to overturn his 2020 election loss to Joe Biden

    Benson suggested to MSNBC that she would work with her counterparts in other battleground states like Nevada, Pennsylvania and Georgia to determine how to proceed with the efforts to stop Trump from running in 2024.

    Lawsuits are already underway from voters in Florida and Michigan who are challenging the constitutionality of Trump’s name being on the ballot. This could force election officials to act – even if they don’t want to.

    Trump said in his Labor Day musing on Truth Social that any attempts to prevent him from being on the ballot is another instance of election interference.

    The claims come as Trump continues to face legal challenges related to his attempts to overturn the 2020 elections results.

    It’s expected that the legal challenges to Trump’s candidacy could make their way all the way to the Supreme Court.

    The potential of using the 14th Amendment to disqualify Trump from running for President again recently gained traction now that the ex-President has been indicted twice for his role in the scheme to overturn his 2020 election loss to Joe Biden.

    A law review article from two conservative legal experts is helping bolster some Republican support for Trump’s disqualification.
