Oklahoma dad is accused of crashing his car then leaving his cheerleader daughter to DIE in wreck after ‘swigging vodka behind the wheel’


Heart-pounding footage shows the moment a man was arrested after allegedly fleeing the scene of a crash that killed his 16-year-old daughter.

The suspect, 41-year-old Elliott Binney, is seen slurring his words four hours removed from his on foot escape – after being loaded into a cop car in suburban Oklahoma.

Hours before, officers found his daughter, beloved local cheerleader Shelby Binney, lying on a desolate road outside a rolled over vehicle in Bixby. Shelby’s mother and two siblings were also present, and taken to the hospital with minor injuries.

Cops eventually discerned Shelby had been ejected from the vehicle, and pegged an already gone Elliott as the driver. Shelby died at a hospital shortly thereafter.

The newly released video begins hours later – when officers from a different department descended on Binney roughly 50 miles from the scene early Friday. 

It was later revealed that cops in Bixby had already found an open bottle of vodka at the crash site – and that Binney admitted to drinking a gulp of it during the fatal ride.

‘Hand out the window, now!’ an officer from the Checotah Police Department shouts to Binney in the newly released clip, which is more than 18 minutes long, and was released on Tuesday.

The footage continues with Binney – seen behind the wheel of a beat-up pickup – putting his hands up with the window down, still in the car.

‘Open the door!’ the officer, joined by three others, exclaims – before the accused daughter killer complies. 

‘Step out slowly!’ the cop continues – with his and his other officers’ guns firmly fixated on the suspect.

Binney then steps out, with all four officers’ guns remaining drawn. 

‘Turn away from me!’ the officer donning the body camera at this point orders – to which Binney again complies with a slow 180.

‘Put your hands both up in the air, and with your right hand grab the collar of your shirt, and pull your shirt up,’ the officer then orders – apparently checking if the suspect has any weapons concealed on his person.

Binney again heeds the officer’s order, doing a full 360 at the lawman’s behest.

‘Keep turnin’, keep turning!’ the cop commands, before ordering the accused DUI offender to stop and lower his shirt. 

‘Take four steps backwards,’ he adds – to which Binney also complies.

The officers than talk about bringing him in, before charging him with first degree manslaughter and passing a vehicle in a no-passing zone. Later that day, he was freed from jail on a $102,100 bond

The officers than talk about bringing him in – after finding marijuana, pill bottles, pipes, and several empty alcohol bottles in the suspect’s trunk, the footage shows.

In the car that crashed, officers also found an unsealed bottle of vodka next to the passenger door, the suspect’s arrest warrant stated. 

The warrant added that the suspect, upon being questioned, eventually owned up to drinking at least one swig from it during his ill-fated drive, where witnesses said Binney had been driving roughly 70 miles mph while passing multiple cars in a no passing zone as it was rained.

As the officers discuss whether to bring the suspect back to Bixby given their jurisdiction, the officer sporting the dash cam goes to the cop car where Binney is being held to perform a quick interview.

He asks the restrained man: ‘What kind of weapons do you have with you?’

Binney, already with visible bruising all over his face, replies: ‘A pocket knife.’

‘No guns? No other big knives? Nothing like that?’ the officer asks. 

During a search of the car – not to be confused with the one he allegedly crashed a few hours earlier – cops found marijuana, pill bottles, pipes, and several empty alcohol bottles in the suspect’s trunk, the footage shows

An arrest warrant added that the suspect, upon being questioned, eventually owned up to drinking at least one swig from it during his ill-fated drive, where witnesses said Binney had been driving roughly 70 miles mph while passing cars in a no passing zone as it was rained

A close friend told News on 6 the sophomore always ‘encouraged everyone’, while her cheerleading teammates issued an emotional statement Friday in remembrance

‘I’m pretty positive, the suspect answers, slurring his words despite the brief, three-word answer.

He goes on to add, still slurring: ‘That truck’s pretty dirty – no telling what’s in there.’

The officer goes on to ask whether the man has a medical marijuana card, given the fact they found an unspecified amount in the second vehicle, along with a litany of pipes.   

‘I had it – I don’t have it with me,’ Binney responds, before adding, ‘It’s… in my wallet. I don’t know where my wallet went.’

The interview ends there, with the unnamed officer telling the suspect that he will soon be checked out by EMS. 

‘Hang tight for us, alright?’ he tells him – to which Binney replies: ‘OK.’

Cops proceeded to book the perp for first-degree manslaughter and leaving the scene of a fatality accident, after discerning that he, like the rest of his family, only only suffered minor injuries.

FOX23, after perusing the suspect’s criminal history, found that he had several cases containing the same charge for leaving the scene of a crash dismissed, including ones in 2010 and 2016.

He is seen sporting two black eyes in his arrest photo as well as an array of heavy bruising – hours before being freed on a $102,100 bond the same day as his arrest.

In a statement, Bixby Police Chief Todd Blish described how he and his department believed the incident takes place.

In a statement, Bixby Police Chief Todd Blish called the case ‘devastating’ and ‘preventable’

‘A vehicle was discovered to have passed in a no-passing zone and lost control in the rain, and the vehicle flipped and overturned,’ he explained, recalling how Shelby, her parents, and two siblings were on their way home Thursday night around 9:20, when her dad caused the crash. 

‘He left the scene on foot before officers could arrive, and he was able to obtain a second vehicle and fled, and we were able to track that vehicle electronically and found him in Checotah,’ Blish added.

‘It tears at your soul when a child is killed in a traffic accident, especially accidents or incidents that are preventable,” he went on, calling the case devastating  

‘It affects that family. It’s a burden they’re going to bear the east of their life, not to mention her friends and family and our officers that responded to the scene. They’re affected by this too.’

Shelby, meanwhile, was a long-time member of Oklahoma Xtreme Allstar Cheer and Tumbling team in Bixby, and a standout sophomore at her local highschool where she was remembered by friends as an uplifting presence, as well as kind and hard working. 

A close friend told News on 6 the youngster always ‘encouraged everyone’, while her teammates at Allstar and Cheer issued an emotional statement Friday in remembrance.

Thursday night OXC lost our sweet Shelby Binney to a car accident,’ the post read.

‘Our thoughts and prayers are with the Binney family during this tragic time. 

‘Shelby has been apart of the OXT and OXC family for many years. She was loved by everyone around her. 

‘She was a bright light in the gym, a hard working athlete, and the best teammate you could ask for. 

‘She had a heart of gold and showed kindness to all. Shelby always had a smile on her face. She loved her teammates, coaches, and the gym. We miss her terribly. 

‘Please pray for her family and all those whose lives she touched.’ 

Cops’ investigation into the incident, as of Thursday, remained ongoing. A trial date for Binney has yet to be set.
